State Attorney General Jen Paxton and Representative Beth Van Duyne (R.-Texas) sued the CDC alleging the agency exceeded its authority by mandating face coverings in airports and on airplanes.

A statement read, “President Biden cannot continue governing through executive edicts… Now is the time to strike down his administration’s air-travel mask mandate.”

CDC Director Rochelle Walensky has said that the agency will look at revising masking guidance but did not provide a timeframe.
