Trump Admin Requests to Revoke Special Privileges for Venezuelans

The Trump administration has reportedly requested the Supreme Court to support its initiative to terminate the Temporary Protected Status (TPS) for approximately 350,000 Venezuelan nationals.

Solicitor General John Sauer filed a 38-page emergency appeal, challenging a federal judge’s ruling that prevented Homeland Security Secretary Kristi Noem from ending TPS for Venezuelans.

Noem announced her decision in February, stating that the program, which was established during the Biden administration in October 2023, was no longer in America’s best interest.

She claimed that conditions in Venezuela had improved enough to warrant the termination of TPS, which had allowed many Venezuelans to reside in the U.S. without fear of deportation.

In April, U.S. Senior District Judge Edward Chen sided with the National TPS Alliance, blocking Noem’s decision.

Chen argued that ending TPS would cause “irreparable harm” and negatively impact the economy.

He noted that TPS recipients tend to be more educated and actively involved in the workforce compared to American citizens.

Sauer contended that the judge’s ruling undermines the executive branch’s authority over immigration and foreign affairs.

He claimed that terminating TPS is a discretionary decision that Congress has entrusted to the Secretary of Homeland Security.

The appeal emphasizes that the court’s intervention disrupts established immigration policies and extends a temporary status indefinitely, contrary to legislative intent.

The Supreme Court recently blocked the Trump administration from deporting Venezuelan individuals suspected of being part of the Tren de Aragua gang under the Alien Enemies Act, with Justices Clarence Thomas and Samuel Alito dissenting.

The outcome of this latest appeal could significantly impact the lives of many Venezuelans living in the U.S. under TPS.
